TENANCY DEPOSIT COMPENSATION

If you have entered into an Assured Shorthold Tenancy Agreement in or after 2012, your landlord is required (by law) to protect your deposit within a government-backed deposit protection scheme within 30 days of receipt, using one of the following schemes:

  • Tenancy Deposit Solutions Limited (TDSL), also known as MyDeposits
  • The Deposit Protection Service (DPS)
  • The Tenancy Deposit Scheme run by the Dispute Service Limited (TDS)


In addition to the above, your landlord must provide you with details of the whereabouts of your deposit together with a leaflet with respect to the scheme, this must be done by your landlord within 30 days of receipt of the deposit.

  • Fail to place your deposit into a deposit protection scheme at all
  • Fail to place your deposit into a deposit protection scheme within 30 days
  • Fail to provide you with details of the deposit protection scheme within 30 days

Should you meet the criteria above, you are entitled to pursue a claim for compensation even in the following instances:  

  • Where your landlord returns your deposit
  • Where you no longer reside at the property 
  • Where your rent and/or deposit is paid for by the council

Funding / Fees for Tenancy Deposit Matters

Please note that our fees for Tenancy Deposit matters can be funded using a Conditional Fee Agreement, commonly known as a 'no win no fee' agreement.  This means if your claim is unsuccessful, you will not be required to pay us (subject to terms and conditions, including a successful allegation of fraud and/or early discontinuation of a claim). If your claim is successful, we are likely to obtain a portion of our costs from the other side, and you will pay us the remainder plus a success fee.  


There are also likely to be fees for disbursements such as counsel fees, etc.
